Your first appearance is usually called a “mention”. The Magistrate will confirm your identity, check whether you have received the police QP9 Court Brief and ask whether you are seeking an adjournment or are ready to enter a plea. In many cases, particularly where you intend to plead guilty, it is sensible to seek a short adjournment so that you can obtain legal advice, complete a Traffic Offenders Program and gather supporting material before finalising the matter.
Queensland law imposes mandatory disqualification periods for most drink and drug driving offences. The length of the disqualification depends on your BAC, the type of charge, your traffic history and any aggravating features. With proper preparation, our Cairns DUI Lawyers can often persuade the court to keep the disqualification towards the lower end of the range and, in some cases, help you apply for a restricted work licence so that you can continue driving for employment.
Eligibility for a restricted work licence depends on several factors, including your BAC, whether you were driving for work at the time, your traffic history, and whether you were already subject to other sanctions. In some circumstances we can ask the court not to record a conviction, which can be particularly important for people who hold professional licences or who frequently travel overseas.
Completing a recognised Traffic Offenders Program is often viewed favourably by the court because it shows that you are taking the matter seriously and are willing to learn from the experience. We almost always recommend that clients complete such a program before their sentencing date at Cairns Magistrates Court, and we can direct you to appropriate providers.
