What's on this page

How might a matter like yours run at Holland Park?

This worked example is hypothetical. It is not a client matter, and it does not predict an outcome. Every case is different.

A driver with an open licence is stopped by police on Logan Road on a Saturday night. The breath analysis gives 0.16. The driver has no previous traffic history and works as an office administrator in Garden City.

What follows under Queensland law:

  1. Roadside. At 0.16, the licence is suspended immediately until the charge is decided. The 24-hour rule applies only below 0.10.
  2. The charge. A reading of 0.15 or more falls into the high alcohol limit, dealt with as under the influence (UIL). The first-offence maximum is 40 penalty units ($6,908) or 9 months' jail. The disqualification is at least 6 months.
  3. Work licence. None is available. A s 87 licence is ruled out at 0.15 or more, however hard the driver's commute.
  4. The court day. The Notice to Appear lists the matter at Holland Park. The driver brings a Traffic Offenders Program certificate and references, and arranges a lift home.
  5. After the disqualification. Because the reading was 0.10 or more, the driver must use an interlock for 12 months after relicensing (TORUM ss 91I and 91N), on a probationary licence.

If the reading had been 0.12, the same driver might have been eligible for a work licence, and the disqualification range would have been 3 to 12 months. The rest of this page explains each step.

Can you drive before court?

That depends on your reading (Transport and Main Roads):

  • Below 0.10: you are suspended for 24 hours.
  • 0.10 or more, a failure to provide a specimen for analysis, or a further charge while one is pending: you cannot drive until the court deals with the charge.

The court can make a s 79E order allowing limited driving in the meantime, but only in narrow circumstances. See our special hardship licence guide.

How long will you lose your licence for?

On a guilty plea, a Queensland court must disqualify you, whether or not it records a conviction. For a first offence under the Transport Operations (Road Use Management) Act 1995:

Your situation Disqualification range
Open licence, 0.05 to under 0.10 2 to 9 months
L, P, probationary or no licence, over 0.00 3 to 9 months (1 to 9 months for particular vehicles)
0.10 to under 0.15 3 to 12 months
0.15 or more, under the influence, or no specimen 6 months minimum

The maximum fines are 20, 20, 28 and 40 penalty units ($3,454, $3,454, $4,835 and $6,908 at $172.70 a unit), with possible jail of 3, 3, 6 and 9 months. A second offence within 5 years increases all of these. See our QLD drink driving penalties guide and our Queensland drink driving offences guide.

Will a work licence get you to work?

Possibly, but the exclusions are wide. The s 87 checklist (TMR – restricted licence):

  • you held an open Queensland licence at the time;
  • your reading was below 0.15;
  • you were not driving for work, and not driving a truck, tractor, bus or other particular vehicle;
  • you have had no suspension, cancellation, disqualification or drink/drug driving conviction in the past 5 years;
  • you can show you are fit and proper, and that refusal would cause extreme hardship by depriving you or your family of the means of earning a living.

Southside commuters should be ready to explain why buses and the busway cannot get them to work on their shifts. Our DUI restricted work licence guide explains the affidavits.

What about the interlock?

A reading of 0.10 or more, a conviction for under the influence or not providing a specimen, or a repeat offence within 5 years all mean you must use an interlock for 12 months once relicensed (TORUM ss 91I and 91N). You also return on a probationary licence. Our QLD alcohol interlock guide explains how it works.

What should you bring to Marshall Road?

  • Your Notice to Appear.
  • A Traffic Offenders Program certificate.
  • Signed references that mention the charge.
  • Your work licence affidavits, if you are eligible.
  • Someone to drive you home.

Our Queensland DUI court process guide explains the sentence hearing. Drug detections are covered in our Queensland drug driving guide.

Which Holland Park list will you be in?

Holland Park's 2026 calendar has 2 lists that matter for drink and drug driving:

  • Police traffic offences, 9am. This list sits on 2 Fridays most months. The remaining 2026 dates are 13 and 20 November, and 11 and 18 December.
  • Transport callover, special hardship orders (SHO) and TORUM applications, 1.30pm. This list sits on Mondays. The remaining 2026 dates are 2, 9, 16 and 23 November, and 7 and 14 December.

Arrests, remands and summary hearings are listed at 9am on Mondays, Tuesdays, Thursdays and Fridays. The practice notes say matters transferred to Holland Park first go to a callover date in Court Room 2. Your Notice to Appear names your date and time, and it is the document to follow.

Queensland penalty changes in 2026: check your offence date (law checked 20 Oct 2026).

Offences on or after 31 August 2026: higher maximum fines apply. They are 20 penalty units ($3,454) for the general alcohol limit and no alcohol limit offences, 28 ($4,835.60) for the middle alcohol limit and 40 ($6,908) for driving under the influence of liquor or a drug. A first general alcohol limit conviction (0.05 to under 0.10) on an open licence now carries 2 to 9 months' disqualification. For offences before 31 August 2026 it was 1 to 9 months. Police can now give an eligible first low-range driver on an open Queensland licence an infringement notice of $1,295 instead of a court charge. Unless the driver elects to go to court, a 2-month disqualification follows. It counts as a conviction, and there is no work licence for that period. Drug driving (a relevant drug present) has not changed yet. The maximum is 14 penalty units ($2,417.80) or 3 months, with 1 to 9 months' disqualification on an open licence and 3 to 9 months for learner, P-plate and unlicensed drivers.

Offences on or after 1 December 2026: minimum fines start for drink and drug driving. For example, the minimum is 7.5 penalty units for low range and for drug driving. The drug driving maximum rises to 28 penalty units, and a first offence on an open licence carries 2 to 9 months' disqualification. A new offence of driving with a relevant drug present while over an alcohol limit adds 1 month to the disqualification range.

An offence committed before a change is generally dealt with under the penalties in force when it happened. Sources: TORUM ss 78E, 79, 79B, 79H–79J and 86, as amended by the Queensland Community Safety Act 2024 and the Transport and Other Legislation Amendment Act 2026. Penalty unit $172.70 from 1 July 2026.
