What penalties apply to a Pomona drink driving charge?

Here is the Queensland penalty table first, because it is usually the first question. These are the maximums for a first offence under the Transport Operations (Road Use Management) Act 1995 (TORUM), with dollar amounts at the $172.70 penalty unit that applies from 1 July 2026.

The table matches the TMR drink driving penalties table for a first offence (last updated 31 August 2026). If you have a previous drink driving conviction within 5 years, the maximums and disqualification periods increase, your car may be impounded for some offences, and interlock applies.

What the table means in practice

The disqualification is not optional. The Magistrate chooses the length within the range, having regard to your reading and the real or potential danger to the public (s 86(2A)), but cannot avoid it. Even if the court decides not to record a conviction, the disqualification still applies under Queensland law.

Your licence may already be suspended. A reading under 0.10 brings a 24-hour suspension. A reading of 0.10 or more, or failing to provide a specimen for analysis, brings an immediate suspension until the charge is dealt with (TMR).

Getting your licence back. When the disqualification ends, you are reissued with a probationary licence for at least 1 year, and you may need to complete a drink driving course. Where interlock applies, you must drive only a nominated vehicle with an approved interlock for a prescribed period of 12 months (TMR – alcohol ignition interlocks). Can you get a work licence for a Pomona charge?

Possibly, if you held an open Queensland licence, your reading was under 0.15, you were not driving for work or in a particular vehicle, and you have no relevant suspension, disqualification or drink driving conviction in the past 5 years. You must also prove you are fit and proper to drive and that losing your licence would cause you or your family extreme hardship by depriving you of the means of earning a living (TORUM s 87).

The application has to be in front of the Magistrate after you are found guilty and before you are disqualified. It cannot be made later. Because Pomona's registry is open only on Thursdays, leave plenty of time to get the form, prepare your affidavit and gather your employer's evidence. What about drug driving at Pomona?

Drug driving charges usually follow a roadside saliva test. You can test positive for a relevant drug whether or not you felt affected. The penalties and licence consequences differ from drink driving. Our QLD drug driving guide sets them out.

Why does a licence matter so much in the hinterland?

Pomona is a small Noosa hinterland town with a rural setting, weekend markets and short drives to the coast. There is limited public transport, so you may need a car to get to work, take children to school, see a doctor or look after family. A charge can follow a social event or a short trip home. When you come before the court, the context matters, but it has to be backed by evidence rather than just told.

How should you prepare for Pomona Magistrates Court?

  • Check the charge and reading on your Notice to Appear, and match it to the table above.
  • Decide about a work licence early, given the Thursday-only registry.
  • Complete the Traffic Offenders Program and bring the certificate.
  • Collect two or three character references that mention the charge, plus an employer letter about your duties and need to drive.
  • Write a short letter to the court explaining what happened and what you have changed.

Be on time, bring all your documents in printed form and expect basic checks at the entrance. If you are travelling in, allow for limited routes and parking.

Queensland penalty changes in 2026: check your offence date (law checked 20 Oct 2026).

Offences on or after 31 August 2026: higher maximum fines apply. They are 20 penalty units ($3,454) for the general alcohol limit and no alcohol limit offences, 28 ($4,835.60) for the middle alcohol limit and 40 ($6,908) for driving under the influence of liquor or a drug. A first general alcohol limit conviction (0.05 to under 0.10) on an open licence now carries 2 to 9 months' disqualification. For offences before 31 August 2026 it was 1 to 9 months. Police can now give an eligible first low-range driver on an open Queensland licence an infringement notice of $1,295 instead of a court charge. Unless the driver elects to go to court, a 2-month disqualification follows. It counts as a conviction, and there is no work licence for that period. Drug driving (a relevant drug present) has not changed yet. The maximum is 14 penalty units ($2,417.80) or 3 months, with 1 to 9 months' disqualification on an open licence and 3 to 9 months for learner, P-plate and unlicensed drivers.

Offences on or after 1 December 2026: minimum fines start for drink and drug driving. For example, the minimum is 7.5 penalty units for low range and for drug driving. The drug driving maximum rises to 28 penalty units, and a first offence on an open licence carries 2 to 9 months' disqualification. A new offence of driving with a relevant drug present while over an alcohol limit adds 1 month to the disqualification range.

An offence committed before a change is generally dealt with under the penalties in force when it happened. How long will I lose my licence for a first general alcohol limit offence at Pomona?

For a reading of 0.05 to under 0.10 on an open licence, the Magistrate must disqualify you for between 2 and 9 months. On a learner, P or probationary licence, or if you were unlicensed, the range is 3 to 9 months, even for a reading below 0.05.

Will I need an interlock?

Yes, if your reading was 0.10 or more, if you were convicted of UIL or of failing to provide a specimen for analysis, or if this is your second drink driving offence in 5 years. The interlock period is 12 months of driving after the disqualification ends.

Can I avoid a conviction?

The Magistrate can decide not to record a conviction under section 12 of the Penalties and Sentences Act 1992, considering the nature of the offence, your character and age, and the effect of a conviction on your employment and wellbeing.
