He had a really good traffic record, having only incurred 1 low level speeding offence in 2017 since moving to Australia from India about 7 years ago. In other words, he had a very good history.

The offence was slightly aggravated because he was involved in a single vehicle accident. Our client had been going through some personal trust issues at the time with his wife, he was very emotion and upset.

The night before the incident he had a big night drinking, he’d then gone to work the next day. He’d finished work, around 5pm. After work he proceeded to consume 3 large free drinks of whiskey which in all probability equated to about 6 standard drinks. Subsequently, this spiked his blood alcohol reading up to a high level and eventually he recorded a reading of 0.162. As a result that was the reading he recorded and he was duly charged with a high range drink driving offence.

Facts of the Noose DUI Offence

On the afternoon of the incident it was raining. On his drive home from work a car in front of him braked suddenly which caused our client to swerve off to the side of the road to avoid a two car collision. In doing this he’s crashed his vehicle into a ditch. Unfortunately, the vehicle was a write off with a vehicle value of $43,000 car. As a result of the drink driving charge he’s not going to get insurance for the written off vehicle. So that’s going to put him at a massive financial disadvantage going forward.

Therefore, we pressed this as one of our Court submissions that a high level of extra curial punishment was involved due to the significant financial disadvantage he will have to sustain going forward in relation to the damage to his vehicle and the ongoing loan that he will have to continue paying for that.

Our client works as a contract delivery driver for Australia post. So anytime off the road is going to affect his ability to work. His wife has been helping him whilst a children were holidays, but once they are back at school, he’s at a loss as to how he’s going to be able to perform his job and support the family since he is the main income earner.

 

Noosa DUI Case Preparation

In relation to the case preparation we helped organise some very good character references including a very good community-minded reference. One was from his employer, another from his wife and a good strong letter of apology to the Court.

Our client also went along and successfully completed the Queensland Traffic Offender Program, which did give him a good insight as to how dangerous his actions were. He came away from that program thinking himself quite lucky that his matter did not end up in more tragic circumstance such as hurting or injuring someone on the road.

 

Noosa Court DUI Lawyers – Matter Outcome

After preparing all of the material we were able to then present it all to the Court. At the Court sentence hearing we were pushing for the absolute minimum licence disqualification of 6 months. However, the Magistrate indicated that he would usually be considering a licence disqualification period of 9 month because it did involved a crash.

However, due to the clients good traffic history. The steps he has taken since the incident occurred and obviously having a well presented a case before the court today, the Noosa Court Magistrate decided to reduced the period of licence disqualification to the minimum period of 6 months. In addition to the 6 months period of disqualification, he was issued with a fine of $900.
