Poor History
To make matters worse for my client it was his second offence. He had a middle range drink driving offence back about 10 years ago. So that did play a factor in relation to the sentencing.
Case Facts
The facts and circumstance surrounding this matter were that the defendant had gone out for big night out, he parked his car in a restricted area.
He decided to go back to his vehicle about 3:00am and sleep in his car. After sleeping in his car for about four hours. He woke up and had it in his mind that that he had to move his vehicle since he had parked in a restricted area. In relocating his vehicle, he drove down a street where there was a random breath test operation in progress at around 7:30am.
Sydney DUI Court Outcome
At the Downing Centre Courthouse he received the minimum licence disqualification of 6 months which was backdated to the day offence. No fine was issued however a Community Corrections Order was put in place for a period of 12 months.
This effectively means that the client is to be of good behaviour for the next 12 months.
