Which court will hear a Manning drink driving charge?

The court printed on your court attendance notice. For most of the Manning – Taree itself, Wingham, Old Bar, Harrington and Cundletown – that is Taree Local Court, which opens every weekday. Charges from around Tuncurry and Forster usually go to Forster, and the Gloucester valley to Gloucester. The table shows why it matters which one you get.

Why does the opening pattern matter if you are suspended?

Because a roadside suspension lasts until the charge is finished. For a reading of 0.08 or more, driving under the influence or a refusal, police can suspend your licence on the spot under s 224 of the Road Transport Act 2013 (NSW). At Taree a plea can usually be dealt with within weeks. At Gloucester, if the first date is not ready, the next may be two months away, all of it spent off the road. Time spent suspended is generally taken into account when the disqualification is set, but it cannot be got back if the matter is later dismissed.

Can a matter be moved to Taree from another court?

Sometimes. A Local Court matter can be transferred to another venue where there is a good reason, such as the timing of sittings, where you live or where witnesses are. The request is made to the court where the matter is listed, usually at the first mention. If you are pleading guilty and want it finished, a full-time court like Taree or Port Macquarie can be worth asking about. If the charge is defended, the hearing usually stays where the evidence is.

Does the court change the penalty?

No. Every Local Court in NSW applies the same law. Section 205 disqualifies you automatically on conviction, whether that happens in Albert Street or Church Street. For a first offence:

On a second offence within five years (s 9) the periods roughly double and the interlock applies to every range. See NSW drink driving penalties. There is no work licence in NSW at any court; driving while disqualified is a further charge (disqualified driving).

Is the interlock compulsory at Taree?

Yes, for every first mid range, high range, DUI or refusal conviction and every second offence, under ss 209–211. Only an exemption order under s 212 avoids it, and a longer disqualification then follows. Read the NSW interlock rules.

Can a Taree magistrate decline to convict?

Yes, under s 10 of the Crimes (Sentencing Procedure) Act 1999 (NSW): a dismissal or a conditional release order without conviction. That removes the automatic disqualification and any interlock. It is discretionary, becomes harder at higher readings, and s 203 bars a second one for a major offence within five years. See no-conviction orders in NSW. Evidence that tends to matter includes a traffic offenders program certificate, references and an employer letter.

What about penalty notices and drug driving?

A first novice, special, low range or drug presence offence can be dealt with by a penalty notice: a fine and a 3-month suspension, with no court date and no conviction. A positive roadside drug test for THC, methylamphetamine, MDMA or cocaine is an offence under s 111 without any proof of impairment; see drug driving penalties.

Can the charge be defended?

Yes. A breath analysis generally must be taken within two hours of driving and in line with Schedule 3, and who was driving can be disputed. See PCA defences, the court process guide, NSW drink driving offences and other traffic offences.
