In Episode 34 of the Boorman Lawyers Court Reports channel, our principal lawyer, Josh Boorman appeared at Sydney Court DUI Lawyers Downing Centre Local Court on a Middle Range DUI offence.
Middle Range DUI at Downing Centre Local Court in Sydney CBD
Just outside the Downing Centre Local Court which is well known as the busiest courthouse in Australia. In relation to this matter I appeared on a Middle Range Drink Driving Offence. The blood alcohol reading was 0.108.
Next morning DUI offence
Because the offences occurred early the next morning after my client had consumed alcohol, it was classed as a next morning style of offence. The night prior to the offence our client had consumed 6 to 7 drinks between 7 to 11pm at a friend’s place and decided to stay the night.
Our client then slept for about five hours, he had gotten up early and preceded to go home, get ready for work on the Monday morning. On his way home he was pulled over for a random breath test and recorded a BAC reading of 0.108.
Traffic Offenders Program completed
He went and successfully completed the Court approved Traffic Offenders Program. Our client had a completion certificate and a filled out work book to hand up to the Magistrate as proof of his attendance and successful completion of the traffic reformatory course. Due credit was given on sentence to our client for taking these rehab steps.
Prior Criminal History
He did have a particularly serious drugs supply matter from just over 12 months ago. He was place on a 12 month suspended jail sentence.
Luckily for our client his matter fell just three days outside of that suspended sentence period. So no action was taken on that because the suspended sentence had just expired.
Case outcome
We were able to get this disqualification reduced from 6 months down to 3 months, $440 fine, 12 month interlock.
