Our Pine Rivers Court DUI Lawyer recently appeared at Pine Rivers Magistrates Court on a very serious high range drink driving offence. The blood alcohol reading was 0.264 and to make it even more serious the incident involved a single vehicle accident.

Thankfully, nobody including our client was injured. No one else was involved in the incident. However, with a reading over 5 times the legal limit our client was extremely lucky that his incident didn’t end up far worse for him.
Nevertheless, there were some significant and obvious aggravating features including the high reading and the accident. Also the fact that our client had 2 prior drink driving convictions on his record, albeit 11 years and 30 years ago.
On the night of the incident, they had both been drinking heavily and began arguing. It got extremely heated and nasty, so much so that it got to a point where my client tried to removed himself from the volatile situation by going and getting into the car to leave and drive 10 – 15 minutes down the road.
Now his motivation to leave the house at that very volatile point was probably the right thing to do, but the way he went about by getting into his car was all wrong and extremely dangerous.
My clients lucky that his actions didnt involve any other person or result in injury or death.
Personal circumstances of the DUI defendant
Our client was a 66-year-old truck driver however his life began to spiral out of control about 12 months prior to the DUI incident when he had a medical episode at his place of work. As a result, he was given a permanent leave of absence and that left him with no income.
Then a couple of months later his wife was involved in a horrific accident where she fell into a sinkhole on her son’s property and shattered her leg. This has sadly left her wheelchair bound. These 2 significant life changing events saw my client and his wife endure massive emotional, physical, and financial stress which unfortunately led to them both heavily drinking each night. The heavy drinking created a toxic living environment between my client and his wife.

We were able to outline to the Court exactly what had been going on in our clients life for the past 12 months and how certain events saw his life unravel.
More importantly, the steps he’s taken to address his issues. He’s now off the alcohol, he’s been assessed and is getting treatment from a doctor as well.
To our clients credit he also completed the Traffic Offenders Program which showed a willingness to re-educate himself on issues surrounding driver safety.
Our client also obtained well written character references from his workplace confirming the medical episode he had suffered approximately 12 months prior to the incident. Also, a letter of support from his wife outlining and confirming the issues which have plagued their family over the past 12 months.
Our client also prepared a strong letter of apology to the Court outlining his genuine remorse and his want to turn his life around.
All of the evidence we tendered went to support the oral submissions that we had presented before the Court.
In addition we also submitted some comparative case law to assist the Court in handing down a fair and appropriate sentence.
DUI Case Outcome from Pine Rivers Court
We were pleasantly surprised that the Court showed a strong degree of compassion and leniency. Especially considering the seriousness of the incident and our clients very poor record.
Our client received a licence disqualification period of 12 months off the road.
We genuinely believe that due to the case we presented informing the Court of the significant stress that our client has been on in recent times, this played a major role in reducing what would otherwise been significantly heavier penalties.
Our client was also given a period of 10 months probation in order to facilitate his treatment for alcoholism and his pursuit for ongoing abstinence.
Our client was aware of the potential Drink Driving Penalties in Qld. So we certainly had a relieved and happy client who was grateful to be offered a chance to remain in the community and to rehabilitate.
