Low Range PCA at Newtown Local Court
I’m just standing here in front of Newtown Local Court where I have appeared on a Low Range PCA Drink Driving Offence. The blood alcohol reading was 0.065.
This offence occurred before the new low range PCA laws came into effect on 20th of May 2019. Now that the new laws have come into effect in New South Wales all low range drink driving offences now receive an on-the-spot fine and automatic 3-month suspension. These first-time low range drink driving offences are generally not required to go to Court now that that the new laws have come into effect.
Strong evidence showing need to drive
This current offence occurred just prior to the new laws being enacted therefore our client was required to attend Court. In relation to this matter we got together some good evidence.
DUI case evidence
Our client completed the traffic offenders’ program. And, we got some medical evidence from his father, also the fathers Doctor, outlining the very serious nature of his father’s medical health concerns and how much he relies on his son to drive him to and from hospital, medical appointments, specialists appointments on a daily basis.
Court outcome for Low Range PCA
We were able to convince the Magistrates to deal with this matter by way of a Conditional Release Order without proceeding to a conviction. Our client received no licence disqualification but instead a good behavior bond for two years.
