Hornsby Court Drink Driving Lawyers – Repeat DUI Offender

Episode 31 of the Boorman Lawyers Court Reports show, we take a look at a low range drink driving offence at Hornsby Local Court. It was our client’s third offence.

We recently appeared at Hornsby Local Court up in North Sydney on a Low Range PCA offence.

Facts of the Low Range DUI

The client had a blood alcohol rating of 0.053, very low rating. It was classed as a next day type of offence, he’d had some drinks the night before and he’d woken up early and unexpectedly been called into work on a Saturday and had a full night sleep. He got up in the morning. He thought he was fine to drive. He was pulled over for a random breath test, but unfortunately, was just over the limit.

Previous drink driving offences

The problems that did occur in this situation was that my client had some poor prior form.

It was his third drink driving offence with the last being quite a serious one, higher range with the crash 8 years ago. Then before that, there was a special range drink driving offence about 10 years ago. Obviously, that showed that there was a bit of prior offending there for our client.

We were pushing for conditional release order due to the objective seriousness being quite low for this offence. But the Magistrate understandably couldn’t really look passed for the fact that it was his third drink driving on his history and that had to be taken into account.

Case preparation

He did everything right in relation, in the light up of this offence, did the Traffic Offender Program, got some good references, a good letter of apology showed the insight into his offending. We were able to have this on reduced the period of disqualification from the automatic period down to the minimum period of three months, and he was issued with a $400 fine.

But, our client was understanding that it was his third drink driving. It was rightful that nothing more since the in relation to penalties came from this, and he was happy with the outcome. He can then move forward, hopefully, having learned a lot and finally putting these and all of his offending past behind him, so, yeah, a happy client and he’ll move forward. I think it being the last time, he will pay before our court.
