This case is noteworthy because it was our client’s second offence, the first being a middle range PCA offence that occurred ten years ago.

As expected, the fact that this was our client’s second offence played a role in the sentencing process. The Magistrate took into consideration the previous offence when deciding on the punishment for this case. - Our client had gone out for a big night and parked his car in a restricted area.
- He returned to his vehicle at around 3am and slept in the car for about four hours.
- When he woke up, he realized that he had to move his vehicle as it was in a clearway zone
- In doing so, he drove down the road where there was a random breath test at around 7:30am.
Sentencing Outcome
As a result of the offence, our client was handed a minimum disqualification of six months, which was backdated to the day he committed the offence. The Magistrate did not impose a fine but instead ordered a community corrections order for 12 months.
