Our client was a provisional licence holder which meant she was still on her P-Plates. So this meant that she had to adhere to a Zero blood alcohol limit.
She recorded a blood alcohol reading 0.109. To make matters worse for her there were a number of aggravating features of this matter which made our clients situation far more worse than that of an ordinary type of drink driving offence. This included the fact she had a passenger in the vehicle at the time of the offence. She also tried to evade the RBT setup when waived through by Police by continuing to drive pas the setup. This meant Police had to quickly get into their car and chase her down the road.
Burwood Court Case Outcome
Our Burwood DUI Lawyers achieved a great outcome for this client. Given the repeat offence, the passenger, the failure to stop and of course this being the 2nd drink driving offence within a couple of years, our client was lucky to have received the following sentence:
- 6 month minimum license disqualification back dated to the date of the offence.
- 24 month mandatory alcohol interlock program.
- $500 fine.
- 18 month Community Corrections Order (good behaviour bond) with the added order that she remain abstinent from alcohol for that period.
Considering the circumstances and the poor traffic record our client was extremely lucky to have received this particular outcome.
It seems the penny has finally dropped and the Court explained that if she appears back before the Court again in the near future then they would need good reasons not to consider a jail sentence of some kind.
