Today’s case involved a suspended driving offence, highlighting the complexities and challenges that come with defending clients with poor traffic records.

My client had a troubling traffic record, including two alcohol-related offences, the most recent in 2019. Despite serving his suspension for the 2019 offence, he faced another suspension due to accumulating approximately 25 demerit points over recent years. This accumulation led to further complications, including extended suspension periods mandated by the RMS, contingent on passing a knowledge test.

Achieving a Favourable Outcome

The mandatory penalty for a second offence was a minimum of six months suspension, with an automatic 12-month period. However, the magistrate reduced the suspension to the minimum and imposed a $600 fine, a more favourable outcome given the circumstances.
