Court Report: Brisbane Drink Driving Lawyers on Middle Range DUI Charge

Middle Range Drink Driving Offence

In relation to the offence our clients blood alcohol reading was 0.112, and it’s an offence which dated back to the 1st of January just after midnight around New Year’s Eve celebration.  Our client actually lives in Adelaide in South Australia.  Yet he had travelled up to Bribie Island to attend his sisters party where he pre-arranged to stay at the place for the night.

How the Plan B fell apart?

However, just after midnight, my client and his sister ended up getting into quite a large argument, a lot of nasty things were said and things got quite hated.  Due to those unforeseen circumstances, my client was asked to leave at the residence where he had planned to stay that night.  So he was kind of left out in the lurch without any plans of what to do or where to stay.

He had been drinking and he did have his car there.  Unfortunately, he did make the poor decision to get into his car and drive from Bribie Island to Brisbane to look for some alternative accommodation for the night. To make matter worse was the fact that he also had his partner in the car with him at the time which aggravated his situation and the seriousness of the offence.

How he came to the attention of Police?

Certainly, on reflection he admits he should have looked at alternative arrangements other than to get into his car to drive on that particular night.  Now, we explained all of these to the Court.  We also brought to the Court’s attention that even though he was carrying a passenger it was not his manner of driving which brought him to the attention of Police since he was pulled over for the purpose of a Random Breath Test.

He wasn’t speeding.  He wasn’t driving erratically. He was polite.  He was cooperative with the police and he was open and honest about how much he’d had to drink.

DUI Submissions to the Court

We explained the circumstances of how the offence came about, the level of offending that it was at.  It was in the middle range at 0.112, so it was creeping up there and he probably should have known better rather than to get into his vehicle and drive since he would have or at least should have known that he was somewhat affected by the drinks that he’d consumed earlier in the night.

Good Qld Traffic Record but Poor Interstate Record

Luckily for him, he had a nil traffic record in Queensland. He did have a prior DUI offence in Adelaide some years ago but this was not brought to the Courts attention which obviously worked in our clients favour. His previous DUIs about seven years ago were not brought to the Court’s attention.

Strong Character References

We presented some very strong character references in favour of our client.  He does a lot of good work in the community for the disabled and disadvantaged people as a part of his employment. So this went to show that he is otherwise a person of very good character and he gives a lot back to the community and by no means a blight on society.

It also shows that this particular incident was extremely out of character for our client.  However, due to the unforeseen circumstances, it was unfortunate the way the incident came about and not the way he would usually conduct himself.

Middle Range DUI Court Outcome

Our client was fined $900, received 6 months disqualification, and that was it really.  He was happy with the outcome and realized it could have been far greater had the Court become aware of his prior DUI offences in Adelaide.

So it just goes to show that drink driving offences can occur in the most unfortunate of circumstances just like our client today.  It is a message for everyone out there that regardless of the circumstances, you should always look for alternative arrangements rather than getting in your vehicle and drive after you know you’ve had alcohol or consumed drink.  So it is a big lesson for everyone and certainly our client.
