Beaudesert Traffic Lawyer Successfully Argues Special Hardship Order for Client

At the Beaudesert Magistrates Court today, Boorman Lawyers successfully argued for a special hardship order for their client. A special hardship order is a type of application that can be made when a driver has lost all their points, has been put on a good behavior license, and then breaches that license or is caught for high-range speeding.

In this case, the client had lost all their points and was put on a good behavior driver’s license with two points for 12 months. However, halfway through that period, they were caught speeding and received three points, breaching the good behavior license. Boorman Lawyers then represented the client in court to ask for one last chance to keep their license.

Proving Significant Financial Hardship

To successfully argue for the special hardship order, Boorman Lawyers needed to demonstrate that their client would suffer significant financial hardship if they were unable to continue driving. To do this, they obtained an affidavit prepared by the client’s boss, who confirmed the critical role that the client plays as a tow truck driver, and how not being able to drive would impact their ability to work.

Additionally, Boorman Lawyers had the client prepare their own affidavit, detailing their work obligations, home and family life, and the fact that they were a single income earner supporting four kids of their own as well as four foster children. A breakdown of expenses was also included to show that without a job, their family would suffer significant financial hardship.

Demonstrating Fit and Proper Person Status

The court also needed to be convinced that the client was a fit and proper person to be granted a special hardship order and a restricted license for work. To do this, Boorman Lawyers had the client complete the traffic offenders program, which demonstrated their commitment to traffic education and being a safer driver on the road.

Boorman Lawyers were successful in arguing for the special hardship order, and the court granted the client a restricted license for work, specifically for driving their tow truck. The client must wear their uniform at all times when working, and the restrictions will be in place for a period of six months.
